Jeremy Huie Wins Defense Verdict in Significant Asbestos Trial

SAN FRANCISCO: Friday, June 6, 2014 – Partner Jeremy D. Huie successfully defended a forklift manufacturer in a three-week jury trial.  In this complex personal injury case, it was undisputed that the plaintiff contracted malignant mesothelioma, a terminal cancer of the lining of the lung. He claimed that his mesothelioma was caused in part by his occupational exposure to asbestos from forklift brakes allegedly sold by Mr. Huie’s client, the sole trial defendant. After five hours of deliberation, the jury returned a defense verdict, rejecting the plaintiff’s claims for strict products liability and negligence. While the jury found the forklift brakes lacked sufficient warnings, it also found such lack was not a substantial factor in causing harm to the plaintiff.

The trial was presided over by Judge Julia Spain in Pleasanton, California, which is located in Alameda County.
