BEVERLY HILLS – Monday, May 23, 2022: A Los Angeles jury delivered a defense verdict for Edlin Gallagher Huie + Blum’s client, a forklift manufacturer, in Phase I of a bifurcated asbestos trial involving two defendants. The plaintiff was a 79-year-old male aluminum plant supervisor diagnosed with colon cancer. EGHB Partner Jeremy D. Huie tried this case over three weeks before Judge Edward B. Moreton, Jr. in Beverly Hills. H.W. Trey Jones of Jones & Bendon, LLP and Chris Madeksho of Madeksho Law represented the plaintiff.
Phase I of the trial related solely to general medical causation. Plaintiff called two expert witnesses, and Defendants called three expert witnesses. At the end of Phase I, the jury concluded that to a reasonable medical probability, asbestos exposure cannot contribute to a person’s risk of developing colon cancer. The jury’s verdict meant the trial did not proceed to Phase II.
This superlative result shows the skill with which EGHB attorneys try and win asbestos cases. In addition to obtaining defense verdicts in jury trials, EGHB has a lengthy track record of achieving motions for summary judgment, negotiating greatly reduced settlements, and obtaining favorable results in binding arbitrations.
